Successful Spouse Visa application
We were instructed by Mrs ML, a British Citizen, on behalf of her spouse, Mr KL. She wanted her husband to join her in the UK.
Mr KL, was living outside the UK running and managing his business and Mrs ML visited him numerous times in a year. The couple have 2 adult children – 1 child is a US citizen and lived with his family in the US and the other lives in the UK with limited leave to remain, with her family. They had resided with their son in the US, however, they could not settle there and returned to their respective countries.
Mr KL was over the age of 80, when we received instructions. Mrs ML was not employed, however, was exempt from financial requirements as she was in receipt of Attendance Allowance. Mr KL, although fluent in English was exempt from the English Language requirement. MR KL was also a British Subject, prior to acquiring nationality of his home country. Mr KL had previously made 3 unsuccessful applications to join his spouse in the UK.
Our representations evidenced that Mr KL and Mrs ML were in a genuine and subsisting relationship. Our representations also submitted the fact that Mrs ML required assistance from her husband due to her failing health and requested the Home Office to consider the Article 8 rights.
Mr KL’s entry clearance application and his subsequent further leave to remain in the UK as a spouse of a British citizen was granted and the couple are now happily living together.
